Welcome to Servisit by the Servisit Team, we provide our services through the Servisit Platform alongside its tools such as Facebook Page, Messenger, SMS, Calls, and Email. The Terms of Service in using our services will be stated here. If you choose to use Servisit alongside its tools and services, it is assumed that you have read and agreed to all of the Terms and Conditions and Privacy Policy of not only Servisit but as well as the tools it uses. If you do not agree with any one of the Terms and Conditions and Privacy Policy you should immediately stop using Servisit, its tools, and its services.
Supplemental Policies that may be posted from time to time and are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these at any time and for any reason.
Every time you book through us, we will send you an updated version of the Terms of Service and Privacy Policy, it is your responsibility to periodically review these, and by using our services you will be subjected to have been made aware of and to have accepted the changes.
Definition of terms
Platform: The Servisit website alongside the tools it uses to provide you its services.
Service Provider/s: They are an individual or a group of individuals who offer services to the customers, in other words they are the Service Providers one can find using the platform.
User/s: They are the people and/or businesses who find, and book services on the platform and avail services from the service provider.
Supplemental Policies: These are guidelines and rules other than the Terms and Conditions stated that are used to aid the user and Service Provider.when using the platform, its services, and the services of the Service Providers.
User Representations
By using the Platform, you represent and warrant that:
- you are not under the age of 13;
- if you're a minor, you have received parental permission to use the Platform;
- you are or planning to be a User or a Service Provider;
- all required information you provide through the booking process is true, accurate, enough, and complete;
- you will maintain the accuracy of such information and promptly update such information as necessary;
Permitted Use
You may not access or use the Platform for any purpose other than finding and booking of services and Service Providers. As a User of the Platform, you agree not to:
- retrieve data or other content from the Platform to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from the Servisit Team, the Service Providers, and other partners of Servisit;
- make any unauthorized use of the Platform, including collecting personal information of User/s, the Servisit Team, the Service Provider/s, and other partners of Servisit such as, but not limited to, e-mails and phone numbers by electronic or other means for the purpose of sending unsolicited emails, texts, or any other purpose unrelated to finding, booking, and availing services;
- trick, defraud, or mislead the Servisit Team and Service Providers, especially in any attempt to learn sensitive information;
- make improper use of our support services or submit false reports of abuse or misconduct;
- interfere with, disrupt, or create an undue burden on the Platform;
- attempt to impersonate another user, entity or person, or use the platform in behalf of a user, entity or person without their consent;
- use any information obtained from the Platform in order to harass, abuse, or harm another person;
- use the Platform as part of any effort to compete with Servisit or otherwise use the Platform and/or the Content for any revenue-generating endeavor or commercial enterprise.
- harass, annoy, intimidate, or threaten any of our staff, Service Providers, or partners;
- upload or transmit (or an attempt to upload or transmit) any files that are unrelated, offensive, and harmful through the booking process;
- disparage, tarnish, or otherwise harm, in our opinion, us and/or the Platform.
- use the Platform in a manner inconsistent with any applicable laws or regulations.
- use the Platform or use the services provided by Service Providers for any illegal or unauthorized purpose;
- contact Service Provider/s directly to avail services.
- acquire/recruit Service Provider/s to create a business that competes with Servisit.
Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Platform at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Platform. We also reserve the right to modify or discontinue all or part of the Platform without notice at any time.
We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Platform.
We cannot guarantee the Platform will be available at all times. There may be scenarios wherein we will suspend the Platform as necessary due to unforeseen hardware, software or other issues and problems resulting in interruptions, delays, or errors.
We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Platform at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Platform during any downtime or discontinuance of the Platform.
Nothing in these Terms and Conditions will be construed to obligate us to maintain and support the Platform or to supply any corrections, updates, or releases in connection therewith.
Corrections
There is a possibility that the platform will not be free from errors, defects, viruses, or other harmful things that may potentially affect the user. We shall practice the right to the following as soon as possible:
- correct those stated any time without prior notice,
- monitor and control activities, content, and materials on the platform,
- investigate violations of the Terms of Service that are stated here as well as take appropriate actions such as the suspension, or discontinuation of access of a customer to the platform or a service provider's services to be offered if they violate the terms of use,
- report violations that are suspected to be against applicable laws, statutes, or regulations to authorities as well as cooperate with said authorities, and
- to ask for information and data from you that is needed to avail services using the platform and to exercise our rights stated if you don't provide us with needed information, or if the information is provided and is suspected or deemed to be inaccurate, false, and fraudulent information.
Disclaimer
Servisit is merely an online platform that connects its Users to Service Provider/s, and is not a Service Provider itself. Servisit and its team are not responsible or liable for the performance of the service/s done by the Service Provider/s as well as the injuries, accidents, or any activity that happened between the Service Provider and their customer. We only act as a bridge between the User and the Service Provider, the User is not a customer of Servisit when it comes to the services offered by the Service Provider. The User is only the customer of Servisit during the finding and booking process of the service, the user is now the customer of the Service Provider afterward. You are given the opportunity to rate and review the Service Provider, for this will have an impact on the Service Provider's future customers.
In cases wherein the service of the Service Provider is non-satisfactory, or have damaged your property, Servisit will act as a remediator of the User and the Service Provider and a re-service can be done as long as it is within its warranty period (warranty depends on the type of service). If the Service Provider does not uphold their responsibility of fixing the said service, the only remedy possible is a refund of what the User has paid (this is the reason why we highly encourage you to pay through us) and the Service Provider will be removed from Servisit’s list of partners. In addition, if you directly contact the Service Provider we cannot help you remediate the services.
Governing Law
These Terms and Conditions and your use of the Platform are governed by and construed in accordance with the laws of the Republic of the Philippines applicable to agreements made and to be entirely performed within the Philippines, without regard to its conflict of law principles.
Termination
We may terminate or request you to re-do or edit your booking if we deem it necessary due to:
- you’re representing another person or entity without their consent
- the information you've provided is is false, inaccurate, lacking, misleading, and/or incomplete,
- the information you've provided is harmful, unrelated, and/or
- the payment is not provided or is incomplete (if required).
Re-service Warranties
The length of warranty varies depending on the service and starts exactly right after the service. The list below contains the services that are covered by warranties along with the length of the warranty period:
Do take note that the warranty only covers issues regarding the service/s done and not due to external factors such as, but not limited to, improper handling, not following the instructions given by the Service Provider, and intentionally damaging or misuse of the unit or object where the service has been done.
Guidelines in Submitting a Re-service Request
The following are guidelines for a User to request a re-service due to unforeseen effects of the service provided:
- Contact us on our Facebook page or Messenger.
- Receive and fill out the re-service request form.
- Wait for the request to be approved.
Guidelines in Reporting a Service Provider for Damages and Theft
The following are guidelines during cases where the Service Provider, during their service, has committed acts that resulted in damages and loss to the User’s Property.
- Create a police report within 24 hours from the time that the case of damage and theft is made known to you.
- Email the following documents to servisitph@gmail.com:
- Police Report made within 24 hours.
- Description of the case
- Clear picture/s of proof of damage
- Identification information (I.D., Driver’s license, etc.)
- Gcash Details to receive refund
- Other necessary documents (transcript of the service, medical documents, etc.)
- If the Service Provider is confirmed to have done the said acts, you shall receive a refund of what you paid from the service, and the Service Provider shall compensate for the damage and theft, in cases that they don’t follow through they shall receive the necessary consequences and will be removed from Servisit’s list of partners.
Though you may submit a report for damages and theft, it is not guaranteed that your report will be valid and true. The Service Provider may also create a counter-police report and deny any liability with regard to the alleged damages and theft.
